What is the offence?

The law requires you to have third party insurance before you can use a motor vehicle on a road or other public place.

The law also states that you cannot allow another person to use a motor vehicle on a road or in a public place without third party insurance.

It is a well known fact that you cannot drive a vehicle without insurance but perhaps not as well known that you cannot allow someone to drive your vehicle without insurance.

These offences are classed as strict liability and this means it doesn’t matter what your intention was.

What is the penalty?

The courts can impose a financial penalty along with 6 to 8 points or a disqualification. It is also possible to be offered a fixed penalty notice. You would receive 6 points and a £300 fine.

The penalty is the same if you allow another person to use your vehicle without third party insurance.

Please ensure that the fine is paid within 28 days. If you do not you will be taken to court and face a larger financial penalty.

Is there anything I can do to keep my licence?

Yes it is possible to put forward an argument to say there were special reasons to avoid a disqualification or points being put on your licence.

You would have to show that you had a genuine belief that insurance was in place, perhaps you were relying on another family member or your insurance policy was cancelled and you had no knowledge of it.

The court will consider any special reasons argument in full and you and any witnesses will have to give evidence under oath. You may need to supply any supporting documentary evidence.

Are there any defences?

There are defences that can be used:

  • The vehicle had a valid policy of insurance
  • You were driving a vehicle that didn’t belong to you in the course of your employment and that you didn’t know and had no reason to believe that there wasn’t a valid policy of insurance in place
